The Sample Command Policy Letter (Appendix P) in MCO 1752.5A is intended to be an example. Therefore, you should not consider it to be defacto HQ SAPR policy especially paragraph 6. It is NOT HQ SAPR policy that MFS is responsible for conducting SAPR training. As we all know the SAPR program is a command function thus any related training falls squarely on the commander's shoulders not MFS. HQ SAPR encourages you to utilize the training and knowledge expertise of MFS to assist you (or command) in carrying out the training obligations. Individual commanders must establish their own working relationship with MFS as it relates to MFS role in SAPR training. HQ SAPR encourages you to get this word out to your commanders and UVAs so as to eliminate any confusion on SAPR training responsibilities.

 

Victim Advocates and Uniformed Victim Advocates (VAs/UVAs) in those instances where a sexual assault victim exercise their option to switch from a restricted to unrestricted report, any and all information revealed to you while functioning in the capacity of an advocate shall remain confidential unless disclosure is warranted under an exception to confidentiality.  Therefore, upon questioning by law enforcement officials during the course of a criminal investigation, VAs/UVAs shall not divulge any information to law enforcement. On those occasions when disclosure is warranted, the VA/UVA shall confer with the Staff Judge Advocate (SJA) prior to releasing any information to law enforcement personnel.
